These Terms & Conditions apply to services provided under Lawnify, a trading brand of At Your Service Ltd (“Lawnify”, “we”, “us” or “our”). By accepting a quote, making or confirming a booking, instructing us to proceed, or allowing work to commence, you agree to these Terms together with any accepted quote, proposal or service agreement.
Services, Quotes & Pricing
Lawnify provides lawn mowing, ride-on mowing, gardening, hedge trimming, grounds maintenance, green waste removal, weed control, fertilising, lawn care and related outdoor property services.
Quotes are based on the information reasonably available to us at the time, including customer descriptions, photographs, measurements, site inspections or property information. Unless stated otherwise, quotes are valid for 30 days.
If the actual property, lawn condition, access requirements or scope materially differs from what was disclosed or reasonably anticipated when quoted, we may revise the price or seek approval for additional charges before completing additional work. This includes excessive growth, larger areas, difficult access, unexpected waste, additional work, concealed obstacles or conditions requiring additional labour, equipment or materials.
GST will be dealt with as stated in the applicable quote or pricing and in accordance with New Zealand law.
Bookings & Recurring Services
Weekly, fortnightly, three-weekly, monthly or other recurring services are provided at approximately the agreed frequency. Unless expressly agreed otherwise, a recurring service frequency does not guarantee a particular day or arrival time.
Service dates may change because of weather, public holidays, staff availability, equipment issues, access restrictions, health and safety requirements or other reasonable operational circumstances.
Lawnify may postpone, modify or reschedule work where weather or ground conditions make mowing or gardening unsafe, impractical, likely to damage the property or equipment, or unlikely to achieve a reasonable result.
Customer Responsibilities & Property Access
Customers must provide Lawnify with safe and reasonable access to the areas being serviced and disclose known hazards or conditions that could affect our work.
Before service, customers should reasonably remove toys, hoses, loose cables, tools, portable objects, excessive animal waste and other items that may obstruct work or create a hazard. Pets and other animals must be appropriately secured.
Customers must notify us of known irrigation systems, sprinkler heads, underground or concealed cables, pipes, drains, landscape lighting, robotic mower wires, fragile structures or other concealed items that may reasonably be affected by our work.
Where an item or hazard is concealed, not reasonably detectable and has not been disclosed to us, Lawnify will not be responsible for resulting damage to the extent permitted by law.
If our team cannot complete a scheduled service because agreed access has not been provided, Lawnify may charge a reasonable call-out or cancellation charge where that charge has been disclosed or is otherwise permitted by law.
Service Conditions & Results
Lawnify will perform services with reasonable care and skill. However, lawns, gardens and vegetation are affected by natural and environmental factors including weather, season, grass or plant species, soil, drainage, irrigation, disease, pests, weeds and previous maintenance.
Unless expressly guaranteed in writing, we do not guarantee a particular aesthetic, horticultural, growth, weed-control or fertiliser result.
Where grass or vegetation is substantially more overgrown than expected, additional charges may apply before or during the service with appropriate customer approval.
Green waste removal is included only where stated in the service description or quote. Additional waste or rubbish may incur additional charges.
Herbicides, fertilisers and other treatments are subject to weather, application conditions and manufacturer requirements. Customers must inform Lawnify of relevant sensitivities, waterways, animals, plants or other site conditions before treatment.
Cancellations, Rescheduling & Variations
Customers should provide at least 24 hours’ notice when cancelling or rescheduling a booked service. Where less notice is provided, Lawnify may charge a reasonable cancellation fee where previously disclosed and permitted by law.
Lawnify may reschedule, suspend or cancel work because of severe weather, unsafe conditions, inaccessible property, staff illness, equipment failure, emergencies, non-payment or other circumstances reasonably affecting our ability to provide the service.
Work requested outside the accepted scope may be treated as a variation and charged separately. Where reasonably practicable, Lawnify will obtain approval before carrying out material additional work.
Payment & Overdue Accounts
Invoices must be paid by the due date stated on the invoice unless alternative payment terms have been agreed in writing. Lawnify may require deposits, advance payment, payment following completion or periodic invoicing depending on the service or customer arrangement.
Where agreed as part of the applicable contract and permitted by law, overdue amounts may incur interest at 2% per month from the applicable due date until payment.
Lawnify may suspend recurring or future services, withdraw credit terms or require advance payment where an undisputed account remains overdue.
If an amount properly owing remains unpaid for 90 days after its due date, Lawnify may refer the account to a debt collection agency, solicitor or other recovery provider. To the extent agreed and permitted by law, the customer may be required to reimburse Lawnify for reasonable debt collection, enforcement and legal costs actually incurred in recovering the overdue amount.
If an invoice is genuinely disputed, the customer should notify Lawnify promptly with details of the dispute. Any undisputed portion remains payable in accordance with the applicable payment terms unless otherwise agreed.
Property Damage & Liability
Lawnify is not responsible for pre-existing damage, deterioration or defects, or for loss caused solely by conditions outside our reasonable control.
Subject to applicable law, this may include loss arising from concealed or undisclosed hazards, underground services, irrigation components, stones or objects hidden in grass or vegetation, defective property components, extreme weather, pests, disease, actions of third parties or inaccurate information supplied to us.
If a customer believes Lawnify has caused damage or provided a service that does not meet the agreed requirements, the customer should notify us as soon as reasonably practicable and provide relevant information or photographs.
Lawnify must be given a reasonable opportunity to inspect the issue and, where appropriate, propose or carry out a remedy before third-party repair work is arranged, except where urgent action is reasonably required to prevent further loss.
Nothing in these Terms excludes or limits liability or customer rights where doing so would be unlawful.
Health, Safety & Conduct
Lawnify is committed to providing a safe and respectful environment for our customers, employees and contractors.
We may refuse, suspend or terminate a service where there are reasonable grounds, including unsafe working conditions, aggressive animals, unlawful activity, persistent non-payment, serious or repeated breaches of these Terms, or abusive, threatening, discriminatory, harassing or seriously disrespectful behaviour towards our employees or contractors.
Our team may leave a property immediately where they reasonably believe their health or safety is at risk.
Employees & Contractors
Lawnify may use appropriately selected employees, contractors or subcontractors to perform all or part of a service.
Information reasonably necessary to complete the service may be provided to those persons in accordance with our Privacy Policy and applicable New Zealand privacy law.
Commercial & Business Customers
Where a customer acquires Lawnify’s services in trade for business purposes, additional commercial terms contained in an accepted proposal, service agreement, tender, purchase order or maintenance contract may apply.
Where Lawnify and the customer are both in trade, the services are supplied and acquired in trade, the agreement is in writing, and it is fair and reasonable that the parties be bound by this provision, the parties agree that the Consumer Guarantees Act 1993 will not apply to the transaction to the extent permitted by law.
Where a specifically negotiated written commercial agreement conflicts with these Terms, that agreement will prevail to the extent of the inconsistency.
Consumer Rights
Nothing in these Terms is intended to exclude, restrict or modify any right or remedy available under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand legislation where that right or remedy cannot lawfully be excluded or modified.
Privacy, Communications & Photos
Personal information is collected, stored, used and disclosed in accordance with the Lawnify Privacy Policy and applicable New Zealand privacy law.
Lawnify may take reasonable photographs or videos for quoting, documenting pre-existing conditions, service verification, customer updates, quality assurance, health and safety and dispute resolution.
Identifiable private customer or property material will not be used publicly for marketing where permission is required without obtaining appropriate permission.
Customers may receive operational communications relating to enquiries, quotes, bookings, schedule changes, services, invoices and accounts by email, SMS, telephone or other communication channels reasonably used in the customer relationship.
Suspension & Termination
Unless a fixed-term or commercial agreement provides otherwise, customers may cancel an ongoing residential recurring service by giving reasonable notice.
Lawnify may suspend or terminate services on reasonable grounds, including persistent non-payment, material or repeated breaches of these Terms, repeated access failures, serious inappropriate behaviour, unsafe conditions, unlawful requests or circumstances making continued service unreasonable or impracticable.
Amounts properly owing for services already provided remain payable following termination.
Events Outside Our Control
To the extent permitted by law, Lawnify will not be responsible for delay or failure caused by circumstances reasonably beyond our control, including severe weather, flooding, natural disasters, road closures, major outages, government restrictions, emergencies or significant supply disruptions.
Where reasonably practicable, we will take steps to minimise disruption or reschedule the affected service.
General
Lawnify may update these Terms from time to time. The current version will be published on our website. Material changes affecting an existing ongoing service relationship will be communicated where reasonably required.
If any provision of these Terms is invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining provisions.
These Terms, together with the applicable accepted quote, proposal, booking confirmation, service schedule and agreed written variations, form the agreement relating to the relevant services.
These Terms are governed by the laws of New Zealand, and disputes will be dealt with through the appropriate New Zealand dispute-resolution process, tribunal or court having jurisdiction.
